Section 77 of the Building Act 1984 empowers Local Authorities to deal with a building or structure which is in a potentially dangerous condition. If however the danger relates to trees, pavements or public highways please contact Surrey County Council here, as this is their responsibility.
Southern Building Control Partnership has responsibility under the Building Act for ensuring that dangerous structures reported to us are dealt with so that no threat is posed to people in the vicinity.
Upon receipt of a report of a potentially dangerous structure one of our building control surveyors will visit the site as soon as possible to assess the danger and associated risks.
If immediate action is needed to remove the danger, such as a wall in danger of collapse, Section 78 of the Act gives building control the power to have the danger removed ie the structure demolished or barricaded off. If the structure is found to be in poor condition but not dangerous at the time of inspection, we will advise the owner, or serve notice under Section 77 by applying to the Magistrates’ Court, to have them undertake repairs within a reasonable time.
